1. Introduction
Welcome to Dorany Construction & Renovation, a division of Dorany Services Sdn Bhd ("we", "us", "our" or "the Company").
These Terms and Conditions govern the use of our website and the construction, renovation, plumbing, tiling, painting, repair, maintenance and other related services offered by our Company.
By accessing our website, submitting an enquiry, accepting a quotation or engaging our services, you ("the Customer" or "you") acknowledge that you have read and understood these Terms and Conditions.
These Terms and Conditions should be read together with the relevant quotation, invoice, work order and any written agreement applicable to your project.
2. Scope of Services
We may provide services including, but not limited to:
- Residential and commercial renovation.
- Plumbing installation, repair and maintenance.
- Floor and wall tiling.
- Interior and exterior painting.
- Bathroom and kitchen renovation.
- Masonry, plastering and wall repairs.
- Ceiling, partition and carpentry works.
- Waterproofing and other property improvement works.
- General building repair and maintenance.
The availability of each service depends on the project requirements, location, technical feasibility, staffing and any applicable licences, registrations or approvals.
We reserve the right to decline a project where the requested work falls outside our capabilities, cannot be performed safely or lawfully, or cannot be undertaken on commercially reasonable terms.
3. Quotations and Pricing
- Quotations are prepared based on the information, photographs, measurements, site inspections and specifications available at the time of assessment.
- A quotation will identify the agreed scope of work, pricing, materials, exclusions and other relevant conditions where applicable.
- Unless expressly stated otherwise, quotations do not include work, materials, permits, disposal charges, access equipment or other costs not specified in the quotation.
- If a quotation has a validity period, the quoted price will apply only during that period, subject to its stated conditions.
- Where site conditions differ from the information originally provided, we may need to revise the quotation. Any additional work or price adjustment must be communicated to the Customer and approved before the additional work proceeds, except where immediate action is reasonably necessary to address an urgent safety risk.
- Any applicable taxes, including Sales and Service Tax (SST), will be stated where required.
4. Acceptance of Quotations
A quotation may be accepted through a signed document, written confirmation, an authorised electronic acceptance or another method specified in the quotation.
Work will normally commence after the required deposit or initial payment has been received, the scope has been confirmed and necessary arrangements have been completed.
An enquiry, request for a quotation or site inspection does not, by itself, constitute a confirmed booking or binding commitment by either party to proceed with the project.
5. Payment Terms
- Payment amounts, deposit requirements, instalment schedules and due dates will be stated in the accepted quotation, invoice or written agreement.
- Where a deposit is required, work may be scheduled after the agreed deposit has been received.
- For projects involving multiple stages, payments may be linked to agreed milestones, material procurement or completion of specified work stages.
- The Customer agrees to make payments by the agreed due dates using the payment methods communicated by the Company.
- If payment is overdue, we may provide written notice and, subject to the agreement and applicable law, suspend work or postpone further work until the outstanding amount is resolved.
- Any late-payment charges, interest or administrative fees will apply only where expressly agreed and legally permitted.
- Disputes concerning part of an invoice should be communicated promptly, with supporting details. Undisputed amounts remain payable in accordance with the agreed payment terms and applicable law.
6. Changes to the Scope of Work
- Any request to add, remove or modify work after the quotation has been accepted may affect the project price, materials, schedule and completion date.
- Additional work, commonly referred to as a variation, must be documented in writing and approved by the Customer before it is carried out.
- We will communicate any additional charges and relevant time extensions associated with an approved variation.
- Verbal instructions should be confirmed in writing to avoid misunderstandings.
- We are not responsible for completing additional work that has not been agreed upon, except where immediate action is reasonably necessary for safety or to prevent further damage, subject to applicable law.
7. Project Schedule and Delays
- Estimated commencement and completion dates will be communicated to the Customer where reasonably possible.
- Project schedules may be affected by weather conditions, material shortages, supplier delays, unforeseen site conditions, changes requested by the Customer, restricted access, other contractors, authority approvals or other circumstances beyond our reasonable control.
- Where a delay occurs, we will communicate material changes to the schedule as reasonably practicable.
- Any extension of time, revised completion date or adjustment to the project arrangements will be handled in accordance with the accepted quotation and applicable agreement.
- Nothing in this section excludes any rights or remedies available to the Customer under applicable law.
8. Customer Responsibilities
The Customer agrees to:
- Provide accurate information about the property and requested work.
- Ensure we have reasonable access to the worksite at agreed times.
- Obtain the consent of the property owner or other authorised party where necessary.
- Inform us of known structural issues, concealed pipes, electrical wiring, hazardous materials and other relevant site conditions.
- Remove or protect personal belongings and valuables in the work area unless otherwise agreed.
- Arrange any Customer responsibilities specified in the quotation, including utility access, building management approvals or parking arrangements.
- Ensure that instructions and approvals are provided by an authorised person.
- Make payments according to the agreed terms.
Additional costs arising from inaccurate information, restricted access or Customer-requested changes may be charged where agreed and legally permitted.
9. Materials and Workmanship
- Materials will be supplied in accordance with the accepted quotation or agreed specifications.
- Where the Customer supplies materials, the Customer is responsible for their timely availability and for providing accurate product specifications. Our responsibility for Customer-supplied materials is limited as permitted by law and the agreed scope of work.
- Material substitutions will be communicated to the Customer and approved where required by the agreement.
- We will carry out the agreed work with reasonable care and skill and in accordance with applicable legal requirements.
- Natural variations in material colour, texture, grain or finish may occur. We will explain material limitations where reasonably identifiable before installation.
- Work outside the accepted scope, including concealed defects or additional repairs discovered after work begins, may require a separate quotation.
10. Site Safety and Property Protection
- We will take reasonable precautions to maintain a safe working environment and protect the property during the agreed work.
- Construction and renovation activities may involve noise, dust, vibration, temporary service interruptions and restricted access to work areas.
- The Customer should notify us of any specific site restrictions, building rules or safety requirements before work begins.
- Any suspected hazardous materials, unsafe structures or dangerous site conditions may require work to stop until the issue has been assessed and appropriate arrangements have been made.
- Neither party may require the other to carry out work in a manner that violates applicable safety requirements.
11. Permits, Approvals and Regulatory Compliance
- Projects may require approvals from local authorities, building management, property owners or other relevant parties.
- Responsibility for obtaining and paying for approvals will be specified in the quotation or written agreement.
- The Company will undertake work only within the scope of its applicable authorisations, registrations and capabilities.
- Where a project requires a permit, registration, competent person or specialist contractor, the relevant arrangements must be made before the affected work proceeds.
- The Customer must not instruct the Company to undertake work that is unlawful or that breaches applicable building, safety or other regulatory requirements.
12. Inspection, Completion and Handover
- Upon substantial completion of the agreed work, we may notify the Customer that the project is ready for inspection.
- The Customer should inspect the completed work within a reasonable period and notify us in writing of any identifiable defects or items that remain incomplete.
- We will assess reported issues and, where they fall within our contractual responsibilities, arrange appropriate rectification within a reasonable period.
- Completion, handover, final payment and any outstanding minor works will be managed according to the accepted quotation or written agreement.
- Customer use of the completed area, where safe and appropriate, does not automatically waive rights relating to defects or other remedies available under applicable law.
13. Defects and Workmanship Warranty
- Any project-specific workmanship warranty, its duration, coverage and exclusions will be stated in the quotation or a separate written warranty document.
- Where a warranty is provided, the Customer should report a suspected defect in writing and provide reasonable supporting information, including photographs where available.
- Warranty coverage may exclude damage caused by misuse, accidental damage, normal wear and tear, inadequate maintenance, unauthorised modifications, pre-existing conditions or work performed by third parties, to the extent permitted by law and the applicable warranty.
- Product warranties offered by manufacturers or suppliers are subject to their respective terms.
- Nothing in these Terms and Conditions limits any non-excludable statutory rights or applicable consumer protections.
14. Cancellation, Postponement and Suspension
- A Customer who wishes to cancel or postpone a confirmed project should notify us in writing as soon as possible.
- Any cancellation charges, refund entitlements and payment obligations will be determined by the accepted quotation, written agreement and applicable law.
- Where materials have already been ordered, work has commenced or costs have been incurred, the parties will determine the appropriate settlement in accordance with the agreed terms and applicable law.
- We may suspend or postpone work where there is a material payment default, unsafe site condition, lack of necessary approvals, denied access or another substantial contractual issue, subject to applicable notice requirements and law.
- If either party wishes to terminate a project because of a material breach, the parties should follow the notice and remedy procedures in the applicable agreement or, where none exists, those available under applicable law.
15. Limitation of Liability
- We will be responsible for losses and damage to the extent arising from our breach of contract, negligence or other liability recognised by applicable law.
- We will not be responsible for delays, defects or damage caused by pre-existing conditions, inaccurate information supplied by the Customer, third-party work or circumstances beyond our reasonable control, except to the extent that applicable law or our own responsibilities provide otherwise.
- Any limitation or exclusion of liability must be reasonable, clearly communicated and legally enforceable.
- Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law.
16. Photographs, Project Gallery and Marketing
- We may take photographs of work areas and completed projects for inspection, documentation, quality control or record-keeping.
- We will obtain appropriate permission before using identifiable customer information, private property images or project photographs for public marketing, where required by law or the circumstances.
- Customers who do not wish their project photographs to be used for promotional purposes should notify us in writing before publication.
- We will take reasonable steps to avoid disclosing personal information, private addresses or other confidential details in public project galleries.
17. Website Content and Intellectual Property
- Website content, including text, branding, graphics, photographs and other materials owned by the Company, is protected by applicable intellectual property laws.

- Website content must not be copied, republished, distributed or commercially exploited without the appropriate permission, except where permitted by law.
- Project photographs, product images and other materials belonging to third parties remain subject to their respective rights.

20. Complaints and Dispute Resolution
- Customers are encouraged to contact us promptly if they have concerns regarding a quotation, payment, workmanship, project schedule or completed work.
- Complaints should include the relevant quotation or project reference, a description of the issue and supporting photographs or documents where appropriate.
- We will make reasonable efforts to investigate complaints and resolve disputes through good-faith discussions.
- If a dispute cannot be resolved directly, either party may pursue the remedies or dispute-resolution procedures available under applicable law.
21. Governing Law
These Terms and Conditions are governed by the laws of Malaysia.
Any dispute will be handled by the courts or other competent dispute-resolution bodies with jurisdiction under applicable Malaysian law.
Nothing in this section removes any mandatory consumer rights or statutory remedies available to a Customer.
22. Amendments to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, business practices or legal requirements.
